Privacy Policy

Location

Duane uses your location to find Texas historical markers near you and to know when you're approaching one while Drive Mode is on, whether you're driving, biking or walking. This happens on your device. We do not store your location on our servers, build a history of where you've been, or share it with third parties, apart from what a map provider receives to draw the map you're looking at (see Maps below). You can turn location off at any time in your phone's settings, and the rest of the app (browsing the map and tags) still works.

On Android, Drive Mode keeps using your location while the screen is off or you switch to another app, so Duane can tell you about the next marker on the road. While it does, Android shows a notification, and it stops when you end the drive. Your phone's location services (on most Android phones, Google Play services) work out where you are; how Google handles that is covered by Google's privacy policy and your phone's location settings.

What's stored on your device

The stories you've heard, the stops you've saved, the trails you've finished, any bedtime stories you keep for offline listening, and your "Tune Duane" preferences (voice, story style, and similar) are stored only on your phone. So is the start date of your free trial, so Duane knows when it ends. We can't see any of it. Deleting the app removes your progress and preferences, and Reset all progress in Settings clears the stories you've heard and saved.

If your phone backs up app data to iCloud or to your Google account, these settings and your progress may be included in that backup, which Apple or Google protects for you. We can't see your backups either.

Audio narration

Duane's narrations stream from our content delivery network. A request includes the marker's ID and the standard technical information that accompanies any internet request (such as your device's IP address, which our hosting providers may log briefly for security and reliability). These requests do not include your name, an account, or any identifier that ties the request to you. Audio you've heard may be cached on your device so it can play back offline.

When a story has no recording or you have no signal, Duane can read the marker's text with your phone's built-in text-to-speech voice. That text is the marker's public inscription, nothing about you. On some Android phones the voice provider may process it online.

Maps (Android)

On Android, the Explore map and the trail maps are provided by Google Maps. To draw the map, Google receives the area being shown and standard device and connection information. Your use of Google Maps features and content in Duane is subject to the Google Maps End User Additional Terms of Service and the Google Privacy Policy. On iPhone, the map comes from Apple Maps.

Purchases

Tall Tale Mode is a one-time purchase made through the App Store on iPhone or Google Play on Android. Apple or Google handles the payment; we never see your card or payment details. The app asks the store whether your Apple ID or Google account owns Tall Tale Mode so it can unlock it, and on Android it keeps a note on your phone that you own it, so it still works when Google Play can't be reached. Promo and offer codes are redeemed through the store the same way. Apple's and Google's privacy policies cover the purchase itself.

Notifications

If you allow notifications, Duane may let you know about a story nearby or a "this day in Texas history" marker. On Android, a notification also shows what's playing while a story, a drive or Sleep Mode is running, with buttons to pause and skip. These are generated on your device and don't send personal information to us. You can turn notifications off any time in your phone's settings.

Diagnostics you choose to send

Duane keeps a short technical log on your phone to help fix bugs, such as when a story started, how audio was routed, and which markers played. Because it lists markers, it can show roughly where you were. It never leaves your phone unless you tap Send Diagnostics in Settings, which opens your email or share options so you can see where it's going and choose to send it. We use a log you send only to fix the problem you reported.

The website and our early-access list

Before Duane launched, heyduane.com offered an early-access sign-up. If you signed up, we stored the email address you provided (with an email service provider) so we could send you launch updates. We don't use it for anything else, you can unsubscribe from any message, and we no longer collect new sign-ups on the website.

Website analytics

Our website, heyduane.com, uses Google Analytics (GA4) to understand how visitors find and use the site: which pages are popular and roughly where visitors come from. Google Analytics sets cookies and collects standard usage data such as pages viewed, approximate (city-level) location derived from your IP address, and device and browser type. We use this only in aggregate to improve the site, and we have turned off sharing your data with Google for advertising purposes. You can opt out using the Google Analytics Opt-out Browser Add-on or your browser's privacy controls. This applies to the website only. The Duane app itself contains no analytics or tracking.

No tracking or advertising in the app

The Duane app contains no advertising, no third-party analytics or tracking SDKs, and no cross-app or cross-site tracking. We don't sell or rent personal information. On Android, the app includes Google's map and Google Play's purchase components, which talk to Google only to show the map and handle purchases, as described above. (Our website uses Google Analytics as described above.)

Children

Duane is a general-audience app and isn't directed to children under 13. We don't knowingly collect personal information from children.

Your choices

• Turn location or notifications on or off in your phone's settings (on iPhone, Settings > Duane; on Android, Settings > Apps > Duane).
• Reset your saved and heard stories in the app's Settings, or delete the app entirely.
• Send diagnostics only when you choose to.
• Unsubscribe from emails using the link in any message.
• Email us with any question about your data.

Changes

If we update this policy, we'll post the new version here and update the effective date above.
